Ana Castela's life in music is a blast, but, just like in a rodeo, the “boiadeira” also faces serious upheavals. She, who was already sued for plagiarism for the hit “Solteiro Forçado”, now faces another lawsuit for copyright infringement and, with her, is Pedro Sampaio and 12 other defendants. The song that is causing all this fuss is called “Carinha de Bebê”. The artists were sued by Claudemir do Nascimento Alves.

According to the case file, Pedro Sampaio is one of the authors of the song, while Ana Castela is an interpreter along with him. But, first of all, it is important to clarify who is the author of the action. Claudemir claims to be a well-known figure in the brega funk style scene. He is the composer of the song that he claims was plagiarized, called “Upa Upa Cavalinho”. The author had composed the song with Adilson Eugenio, but ended up owning 100% of the work.


The song had already been registered with the competent bodies, it was part of a DVD and a CD. When he heard the hit by Ana Castela and Pedro Sampaio, he soon noticed what he claimed was a “similarity between the melodies and the scores of the songs”. Currently, “Carinha de Bebê” has a music video with more than 53 million views and was only recorded in 2023.


The alleged plagiarism would be even more evident because the expression “Upa Upa Cavalinho” is reproduced in full in the song by Pedro Sampaio and Ana Castela. The authorship was not attributed to Claudemir, and would still have been credited to third parties, with what he claims to be a “purpose of economic exploitation”.

Claudemir asked to be included as co-author of the work “Carinha de Bebê ”, so that he can regularly exercise his supposed rights to the song. He also asked for urgent protection so that numerous music reproduction platforms, such as Apple Music, Spotify, YouTube and others, retain the revenue obtained from music. The same was requested from ECAD. To make matters worse, the author requested that Ana Castela and Pedro Sampaio be banned from singing “Carinha de Bebê” in their shows, under penalty of a fine of R$50,000.


And calm down, as the author says popular saying: “everything can get worse”. The author also asked for the far from simple sum of R$100,000 for moral damages. In addition, of course, to material damages related to the amounts determined during the process. He still wants the defendants to retract their alleged plagiarism on social media.
