Flamengo purchased the land for R$ 138,195,000.00 for the construction of the new stadium, but they still don't know if this will be the total amount to keep the space in the Gasometer region. The rules of the city council's notice place responsibility for possible losses in court on the club's account, in the dispute between Caixa Econômica Federal (CEF) as litigant.
Articles 11.7 and 11.8 of the final version of the notice, dated July 9, make clear the obligation of the successful bidder (Flamengo ) in the payment of "any difference, if any, between the value of the winning bid at the auction and that fixed in the expropriation process".
In the terms of purchase and sale of the property, the club undertakes to assume any judicial liens, taxes, tariffs and fines levied on the property, "renouncing, irrevocably, the right to subsequently charge such amounts from the Municipality".
For the lawyer specializing in administrative law Francisco Defanti, these conditions create some uncertainty about the final amount to be paid by Flamengo to take over the land in the central region of Rio de Janeiro, in addition to directing any possible loss to the club.
"There is no up or down parameter low. The value could be very high. It's a risk. It is the main risk that Flamengo runs. For any bidder who enters this model, the risk is this: you don't know what the value set by the judge will be up front. And Flamengo is committed to paying the difference that may be determined by the judge. This is both in the notice and in the promise of purchase and sale" - said Defanti in an interview with the portal "Lance".
Flamengo trusts in well-done expertise
Flamengo is aware of the litigious process ahead and calculated the risks before entering the auction. Expropriation process

Before the notice, Flamengo offered R$250 million to reach an agreement with the current owners. The expropriation process could have been carried out amicably, but there was no agreement. For this reason, the City of Rio initiated the expropriation process because it considered the property "abandoned and without fulfilling its social function".
Now, an expert was appointed by the Court to determine the value of the property. Any possible divergence with the assessment made by the city hall will be resolved by the judge.

As esperanças de um retorno breve de João Gomes ao futebol brasileiro sofreram um duro golpe nesta quarta-feira (18). O volante, cujo nome voltou a circular nos bastidores do Flamengo nas últimas semanas, deve permanecer na Inglaterra. O Wolverhampton, atual clube do atleta, definiu condições financeiras proibitivas para qualquer negociação e manifestou o desejo de contar com o jogador independentemente do desfecho desta temporada.
Segundo apuração do portal UOL, a diretoria do Wolverhampton considera João Gomes uma peça fundamental para o esquema do técnico Rob Edwards. A avaliação interna é de que o brasileiro é indispensável, a ponto de o clube planejar sua permanência mesmo se a equipe for rebaixada para a Championship (a segunda divisão inglesa) ao fim da temporada.
Para blindar o jogador do assédio internacional, os ingleses estipularam um preço elevado. O Wolves só aceita abrir conversas se a oferta atingir a marca de 60 milhões de euros (aproximadamente R$ 428 milhões na cotação atual). O valor está muito acima da realidade financeira dos clubes brasileiros, o que praticamente inviabiliza uma repatriação pelo Flamengo neste momento.
Do lado do Flamengo, a postura é de cautela e realismo. A diretoria entende que, apesar da recente saída do volante Allan, o elenco comandado pelo técnico Filipe Luís está bem servido de opções para o meio-campo. José Boto, diretor de futebol do clube, explicou a estratégia de mercado em entrevista ao site GE.
"A janela no Brasil fica aberta até março. Estamos atentos ao mercado. É óbvio que nossa disponibilidade financeira agora é muito pequena para esta janela", declarou o dirigente, afastando a possibilidade de loucuras financeiras.
Boto reforçou que o clube segue monitorando situações, mas agirá apenas se encontrar um negócio de ocasião. "Aparecendo uma oportunidade que nos satisfaça do ponto de vista desportivo, alguma posição que nós identificamos e podemos vir a precisar, estamos atentos", finalizou.

A diretoria do Peixe chegou a procurar o estafe do atleta e o Grêmio para entender a situação do colombiano, que retornou ao Brasil com status de estrela após longa temporada na Arábia Saudita. No entanto, os valores envolvidos na operação assustaram a cúpula santista e esfriaram as tratativas.
O principal obstáculo para o avanço do negócio é o alto custo mensal do ex-Flamengo. Atualmente, os vencimentos de Cuéllar superam a casa de R$ 1 milhão, um montante que foge da realidade financeira que o clube da Vila Belmiro pretende praticar neste momento.

Contudo, sua despedida da Gávea foi marcada por atritos. Em agosto de 2019, o jogador pediu para ser negociado visando o futebol europeu. A diretoria rubro-negra, no entanto, dificultou a ida para a Itália e conduziu a venda para o Al-Hilal, da Arábia Saudita, por cerca de R$ 34 milhões.
