0The court decided to extinguish a case opened by Jojo Todynho against Val Marchiori. The decision, published last Friday (24/5), was made by judge Fernando Salles Amaral, from the 1st Court of the Special Civil Court of Vergueiro, São Paulo. Jojo sued Marchiori for moral damages, asking for compensation of R$50,000. In the action, the singer complained about allegedly fat-phobic comments made by the socialite on social media.
It turns out that the artist had missed the hearing, which was scheduled for February 15th of this year. Subsequently, Jojo Todynho's defense presented a justification to the Court, where they argued that they would not have been notified of the hearing held.
The singer's defense then made the following request in the process: “the redesignation of this hearing and that it be held in virtual mode due to the speed and procedural economy, as the plaintiff and his only patron constituted in the case reside in the State of Rio de Janeiro”.
However, the judge considered that it would be clear from the records that Jojo Todynho was duly summoned to the hearing. “Despite the arguments of the author [Jojo Todynho] that she would not have been notified of the hearing held, it is clear in the records that she was duly notified through publication in the DJE of this Court”, he wrote in the decision.
The judge also highlighted that “the allegation that there was confusion in the records should not prosper, since the ordinary act on page 38/40 was clear about the reassignment of the hearing to 02/15/2024, given the amendment of the carnival holiday” concluded the judge.
For the magistrate, there is no justification for Jojo’s absence Todynho, since she was duly notified. In this way, the presenter will have terminated the process, without judging the merits, decided judge Fernando Salles Amaral.

"I fell into depression a month after leaving the program and I struggle with it every day." She also highlighted that she had never faced psychological problems before participating in the reality show.
