This Sunday (11), the Public Prosecutor's Office of Rio de Janeiro (MP-RJ) requested the conviction of seven defendants involved in the Ninho do Urubu tragedy, which occurred in February 2019. The accusation is of negligent arson, when there is no intention to cause damage , but there is proven negligence. The Prosecutor's Office of the 36th Criminal Court of the Capital issued the request after analyzing the case that took the lives of ten young players and left three others injured at the facilities of Flamengo's training center.
Among the names cited by the MP-RJ are managers and technical personnel responsible for the structure of the accommodations and air conditioning units. They are: Antonio Marcio Mongelli Garotti, Marcelo Maia de Sá, Claudia Pereira Rodrigues, Danilo da Silva Duarte, Fabio Hilario da Silva, Weslley Gimenes and Edson Colman da Silva. The MP argues that all of them contributed to the risk environment that led to the fire. Initially, 11 people had been reported , but four were excluded for legal reasons, such as prescription or lack of ties to the location at the time.
The report presented by the Public Prosecutor's Office reinforces that Ninho do Urubu operated without the proper legal authorization. The containers used as accommodation for the base athletes were irregular and did not follow minimum safety standards . According to the Public Prosecutor's Office, the origin of the fire was a thermoelectric problem in an air conditioning unit that was not receiving adequate maintenance, which demonstrates the negligence of those responsible.
The Public Prosecutor's Office claims that the defendants' conduct violated their legal duty to ensure the safety of young athletes . According to the agency, the tragedy was not inevitable, but rather a direct result of the omission and failures in management and maintenance at the training center. The charge of negligent arson seeks to hold the seven individuals involved responsible for not having taken measures that could have prevented the tragedy.
The fire, which occurred in the early hours of February 8, 2019, killed ten Flamengo youth players: Athila Paixão, Arthur Vinícius, Bernardo Pisetta, Christian Esmério, Gedson Santos, Jorge Eduardo, Pablo Henrique, Rykelmo Vianna, Samuel Rosa and Vitor Isaías. Three other young people were injured, while 13 managed to escape.
Mengão secured a 2-1 victory over the São Paulo team with an offensive highlight and is now focusing on the next match against Internacional in the Libertadores.
