Vasco da Gama filed a lawsuit last Monday (30) at the Superior Court of Justice Desportiva (STJD) against changing the second leg games of the Copa do Brasil semi-finals. In this sense, the club fulfills the "threat" made by President Pedrinho.
Previously, the Vasco board was consulted about a possible change and responded negatively. However, even with the refusal, the CBF changed the return game, in São Januário (RJ), from the base date of October 17th to October 20th. The trip, to Arena MRV (MG), will be this Wednesday (2).
Both Atlético-MG and Flamengo were in favor of the change due to Data FIFA. Rubro-Negro's opponent will be Corinthians, who also showed their opposition, as did Vasco. The duel between them will take place on the 2nd and 19th of October.
Cruzmaltino understands that Atlético and Fla will benefit from this decision because players from the two clubs defending national teams will have more rest time; the FIFA Date runs until October 15th. President Pedrinho stated last weekend that Vasco played in an identical situation, with some players returning in the early hours of the day of the game against Athletico (in the quarterfinals). The club also interprets that the change in dates violates the rules, which motivated the preparation of the action in the STJD.
What is Vasco based on?
Vasco is based on articles from the General Competition Regulations (RGC) of the CBF to go to the STJD:
"It is the responsibility of the DCO... to prepare and enforce the Annual Calendar of Competitions and their respective tables";
"The call-up of athletes to join national teams does not guarantee their clubs the right to change the dates of their matches in competitions";
The parties that can request a change in the date of a match are: home club, sending federation or holder of broadcasting rights. Vasco claims that the request came from the visitors (Atlético-MG).
Labor court judge sees 'delaying intent' in Mengão's decision to appeal against employee who was on duty on the day of the fire

Flamengo lost again in the lawsuit filed by Benedito Ferreira , the club's former security guard who worked during the fire at Ninho do Urubu in 2019. In the first instance, the professional won the right to receive compensation of R$600,000, including R$100,000 for moral damages and R$500,000 for material damages , in addition to a lifetime pension until the age of 78. Rubro-Negro can still appeal the decision.
Labor judge Bruno Andrade de Macedo imposed a 2% fine when he rejected Flamengo 's motion for clarification against the previous ruling. According to the judge, the motions were used with a "clearly delaying intent," unjustifiably delaying the delivery of the judicial decision and violating the principles of speed and efficiency.
Benedito Ferreira helped rescue at least three victims during the Ninho do Urubu fire, which killed 10 young people from Flamengo 's youth academy in February 2019. He was fired in 2022, after working at the club since 2008, and filed two lawsuits against the institution , one while still an employee, demanding labor, social security and civil rights.
The main allegation is that Flamengo failed to register his dismissal with the INSS (National Institute of Social Security) due to the fire . The judge emphasized that, even if Benedito were reinstated in a different role, this would not eliminate his right to a monthly pension, considering the total reduction in his capacity to perform his previous role.
The case included a medical examination that found that Benedito suffers from Depressive Disorder, Adjustment Disorder, and Panic Disorder , with worsening symptoms and suicidal ideation. The report also concluded that the pathologies are occupational in origin, with a causal or concausal link between the injuries and his work at Flamengo.
The judge also considered Benedito's dismissal a "wrongful act," as the club was aware of the medical treatment required for the occupational injury . The expert stated that the security guard is "unfit with restrictions for the work he performed at the Defendant or any similar work," demonstrating a loss of fitness for his original role.
