The case involving Gabriel Barbosa, known as Gabigol, and a possible attempt to cheat an anti-doping test, will be decided by the Court of Arbitration for Sport (CAS) on June 7th. The player from Flamengo, who was initially suspended for two years by the Anti-Doping Sports Justice Court (TJD-AD) in March, achieved a suspensive effect by appealing to the international court, allowing him to continue playing while awaiting the verdict final.


Gabigol's situation began to gain notoriety when he was suspended by the TJD-AD, a decision that generated great repercussion in the sports world. The attacker did not accept the punishment and decided to appeal to CAS, the court of last instance in sport. Information about the trial was initially released by journalist Venê Casagrande and confirmed by ge. Gabigol will travel to Switzerland to participate in the trial in person, but this will not affect his participation in Flamengo's games in early June. The red-black team will face Vasco on the 2nd and Grêmio on the 13th.


FLAMENGO AND GABIGOL WILL APPEAL 


The court will consist of three referees, two appointed by CAS and one by Gabigol's defense. Initially, the Brazilian Doping Control Authority (ABCD) appointed a German arbitrator, but documentation was refused for administrative reasons, resulting in ABCD losing its right to appoint the arbitrator. As a result, the judging panel was made up of an Englishman nominated by Gabigol's defense, as well as another Englishman and a Swiss nominated by CAS.

In its defense, the Bichara e Motta firm used legal arguments to obtain the suspensive effect. They highlighted the "periculum in mora" (danger of delay) and the "fumus boni juris" (smoke from good law) so that the process could be analyzed quickly. The defense argued that, if there was a delay in the analysis, Gabigol could serve a large part or even the entire suspension period unfairly.


In addition, the defense highlighted the close vote in the TJD-AD, where five votes were in favor of the suspension and four against. This detail was used to show that the initial decision was not unanimous and that there is room for contestation. The defense's legal brief also anticipates other arguments that will be used in the appeal, in an attempt to annul the suspension imposed on the player.
