Flamengo and 6 other clubs threaten to sue the LFU: Understand

Flamengo, Palmeiras, São Paulo, Atlético-MG, Santos, Grêmio and Vitória, all members of Libra, made an extrajudicial notification with questions to the LFU (Liga Forte União) for what they classify as misuse of the brand. This irregularity would be committed in materials used by LFU in market research in the sale of Brasileirão broadcasting rights from 2025 onwards.

According to them, if the request in this notification is not met, they can take legal action against the LiveMode. The agency is responsible for negotiating the names of clubs such as Corinthians, Internacional, Fortaleza, Athletico, Fluminense, Vasco, Botafogo and Cruzeiro. The Libra clubs also make demands to the CBF, which received another document.


The column had access to the document that was delivered on the last day August 15for both parties and also for the material used by LiveMode in presentations by interested companies.


In this material, there are photos and uses of the symbol of all teams Brasileirão and not just those who belong to the LFU. There is, for example, a photo of Hulk with the Atlético-MG shirt.

"By making improper use of the brands and rights of the Notifiers, illegally taking advantage of their projection through the falsification of supposed relationship between the Parties, you violate current legislation and cause harm to the investments made by the Notifiers in their respective commercial strategies, in addition to benefiting at your own expense without authorization", states the document.


" It should be noted that these never chose to associate with the Notified companies, however, they have their image and other distinctive signs maliciously reproduced with heightened prominence, causing the false impression in the recipient of the Commercial Presentation that the Notifiers", he adds.

The extrajudicial notification asks that everyone who had contact with the presentation be warned that the LFU does not have the right to negotiate the rights of clubs that are on Libra and that they stop using the brand within 24 hours of receiving the document . If this is not done, the clubs can take legal action.

CBF is also notified

< The same clubs sent another document to the CBF to find out if the entity granted permission to LiveMode to use the clubs' brands and if a power of attorney was also issued for the agency to sell properties that currently belong exclusively to the CBF.

In the presentation, the LFU raises the possibility of negotiating media packages such as the presentation of the brand on a replacement plate, naming rights for the best of the game award and even the definition of the competition calendar.

"Through the indistinct and purposeful reproduction of the competition's official logo, LiveMode also suggests that any commercial partnership will lead the interlocutor to be part of a supposed '50-year investment' in the Brasileirão, which also does not match reality, as in which any specific agreements with certain participating clubs are not to be confused with an 'investment' in the Brasileirão, or in the group of clubs that compete in it", say the clubs in this notification.

In the presentation in question, the offer was made for Betfair, which is a competitor of Betano, the company that gives its name to the Brasileirão, which could generate a conflict that affects all clubs, according to the document.

"(The clubs) respectfully request that CBF adopts all appropriate measures to ensure that LiveMode immediately refrains from improperly using brands and properties that are not its property, especially with regard to Brasileirão, for commercial purposes. In this sense, the Signatory Clubs now make themselves available to the CBF to, together with the entity, combat the conduct reported here."
