At the request of Fluminense and Flamengo, Justice overturned Vasco's injunction to play against Atlético-MG, next Sunday, at Maracanã. The match was scheduled for 11 am (Brasília time). The Justice of Rio pointed out that "the preservation of the soccer field where the matches are held constitutes an essential activity".
Vasco had everything ready to start selling tickets, but it was waiting for the decision. The club will now appeal and claims it will not give up playing at Maracanã.
“This is the 3rd Precautionary Guardianship Antecedent postulated in court, in which the applicant protests in the face of the defendant's refusal to allow the holding of a match valid for the Brazilian Football Championship, at the Maracanã stadium, between Vasco and Atlético Mineiro, for the 20th round", says the document.
"Regarding the assumptions required for the preliminary injunction, I still fail to identify the periculum in mora, since there are other stadiums in the State of Rio de Janeiro in conditions to guarantee the right of consumers of products with an adequate quality standard, such as Engenhão in the same Municipality and other stadiums in the interior, so that there will be no danger of the match not taking place", says part of the note .
Judge Mauro Nicolau Junior, from the 43rd Civil Court of the Court of Justice of Rio de Janeiro, had granted last Monday night an injunction for Vasco to play against Atlético-MG. With the new decision, Vasco intends to appeal to the special body of the TJRJ, composed of 25 judges. It will be drawn between one of them this Thursday morning.
