The Brazilian Authority of Doping Control (ABCD) waited until the last possible day to appoint the referee who will represent her in the trial of striker Gabigol's suspension appeal at the Arbitration Court of Esporte (CAS), in Switzerland.

Gabigol's defense filed the appeal on April 2, along with the choice of its referee, and the prosecution used the maximum period of two weeks to nominate its representative. It is still necessary to appoint a third arbitrator, by the CAS itself, so that a decision can be made on the suspensive effect.

The expectation of Gabigol's defense is that this appointment will take place by the end of this week. From then on, the decision on the suspensive effect can be made at any time – there is no deadline or date set for judgment, with the arbitrators' decision only being informed to the parties to the process.

In the appeal, Gabigol's lawyers ask speed of the court, as the delay could result in Gabigol serving much or even all of the suspension without there being a final decision from CAS on the sentence itself. To guarantee this speed, Gabigol's defense even paid the part of the legal costs that would be borne by ABCD so that the process would not be delayed further.

The defense's expectation is to achieve the suspensive effect by the end of this month. Until then, Gabigol will continue to maintain his physical fitness at home, as he cannot visit Flamengo's facilities during his suspension.


Gabigol was suspended last month, retroactively for two years from the 8th of April 2023, for alleged fraud in an anti-doping test at Ninho do Urubu. The defense is betting on the tight margin of conviction, of 5 to 4 in the plenary session of the Anti-Doping Sports Justice Court, to trust in the success of Gabigol's appeal.
